Consent & Confidentiality Policy

At Joshua Tree Learning Centre, we recognize that trust is the foundation of meaningful therapeutic, educational, and assessment services. We are committed to protecting the privacy, dignity, and confidentiality of all clients while ensuring that individuals and families understand their rights and responsibilities regarding consent and information sharing.

Informed Consent

Before services begin, clients and/or parents or legal guardians will be provided with information regarding:

  • The nature and purpose of the service
  • Potential benefits and risks
  • Fees and payment expectations
  • Limits of confidentiality
  • Record keeping practices
  • Client rights and responsibilities

Participation in services is voluntary, and informed consent must be obtained before services are provided.

Clients may withdraw consent at any time, subject to applicable legal, ethical, or professional obligations.

Consent for Children and Youth

For clients under the age of majority, consent is generally obtained from a parent or legal guardian before services begin.

Depending on the age, maturity, and circumstances of the child or youth, clinicians may also seek the young person’s assent and involvement in decisions regarding their care.

Joshua Tree Learning Centre values collaborative relationships between clinicians, children, youth, and caregivers whenever appropriate.

Confidentiality

Information shared during counselling, assessments, consultations, group programs, and other services is treated as confidential and handled in accordance with professional, ethical, and legal requirements.

Client information will not be disclosed to third parties without written consent except in circumstances where disclosure is required or permitted by law.

Limits to Confidentiality

There are circumstances in which confidentiality may be limited. These may include situations where a clinician has reason to believe:

  • There is an immediate risk of harm to the client or another person
  • A child may be experiencing abuse or neglect
  • A vulnerable individual requires protection
  • Records are subpoenaed or disclosure is otherwise required by law
  • Professional consultation or supervision is required to support quality care

Where possible and appropriate, clients will be informed if information must be disclosed.

Communication and Electronic Information

While Joshua Tree Learning Centre takes reasonable steps to protect electronic communications, email, online forms, and other digital communication methods may not be completely secure.

Clients are encouraged to avoid sending sensitive personal information electronically unless specifically requested by a member of our team.

Assessments and Reports

Assessment results, reports, and recommendations are confidential and will only be released to authorized individuals or organizations with appropriate written consent, unless otherwise required by law.

Group Programs and Workshops

While facilitators maintain professional confidentiality, participants in groups and workshops cannot be guaranteed confidentiality by other attendees.

Participants are encouraged to respect the privacy of fellow group members and refrain from sharing personal information discussed within the group setting.

Access to Records

Clients may request access to their records in accordance with applicable laws, professional standards, and organizational policies.

Requests for records may be subject to administrative procedures, timelines, and fees where permitted.
